Terms of Use & EULA
These Terms of Use and End User License Agreement ("Terms") govern your use of the Halmist app and service ("Service"), provided by A&D Media und Data GbR, Bornholmer Straße 68, 10439 Berlin, Germany ("we", "us"). By downloading, installing or using the app, you agree to these Terms. If you do not agree, do not use the Service.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own private or internal business use, in accordance with these Terms and the rules of the App Store or Google Play from which you obtained the app.
2. Subscriptions & billing
- The Service is offered as an auto-renewing subscription, billed through the Apple App Store or Google Play.
- Payment is charged to your store account at confirmation of purchase.
- Subscriptions renew automatically for the same period and price unless auto-renewal is turned off at least 24 hours before the end of the current period.
- You manage and cancel your subscription in your App Store or Google Play account settings.
- Prices and available plans are shown in the app before purchase and may change with notice for future periods.
- Refunds are governed by our Refund Policy and the store's rules.
3. Acceptable use
You agree not to use the Service to:
- break any applicable law or regulation, or infringe the rights of others;
- send spam, distribute malware, or launch attacks (e.g. hacking, port scanning, DDoS);
- transmit or access illegal content, including material that exploits minors;
- resell, sublicense or provide the Service to third parties without our written consent;
- circumvent usage limits or attempt to disrupt or reverse-engineer the Service, except where permitted by law.
We may suspend or terminate access for serious or repeated violations.
4. Privacy & no-logs
We operate the Service under a strict no-logs principle. How we handle data is described in our App Privacy Policy, which forms part of these Terms.
5. Availability
We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Maintenance, network conditions or factors beyond our control may affect availability. A VPN improves privacy but does not make you completely anonymous or immune to all online risks.
6. Disclaimer & liability
The Service is provided "as is" to the extent permitted by law. We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slightly negligent breaches of essential contractual obligations, our liability is limited to the foreseeable, typical damage. Any further liability is excluded. Mandatory statutory consumer rights remain unaffected.
7. Changes to these Terms
We may update these Terms as the Service develops or for legal reasons. We will make the current version available at this address and, where required, notify you of material changes.
8. Governing law
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
